What Is Bankruptcy?


Bankruptcy is a legal remedy¬†that¬†helps people who can’t pay their debts. The bankruptcy laws provide protection from creditors by stopping collection efforts, such as harassing phone calls, lawsuits, and wage garnishment. At the end of the typical bankruptcy case, a “discharge” order releases the debtor from the obligation to repay.

In 1934, the United States Supreme Court wrote that bankruptcy “gives to the honest but unfortunate debtor… a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt.” Those words are as true today as they were over 80 years ago.
