Matthew W. Conrad, Attorney at Law, is the founder of Conrad Legal LLC, an Indianapolis law firm dedicated exclusively to helping individuals and families navigate financial hardship through Chapter 7 and Chapter 13 bankruptcy. Before opening Conrad Legal LLC in 2013, Matt practiced law at firms in Indianapolis and Seattle. Additionally, he was a partner for 7 years in a Chicago-based national bankruptcy firm.

Filing Bankruptcy in the Southern District of Indiana

Every Conrad Legal case is filed in the U.S. Bankruptcy Court for the Southern District of Indiana, Indianapolis Division, at 46 East Ohio Street in the Birch Bayh Federal Building. The firm’s office sits one block west at 101 West Ohio Street, which keeps document filings, 341 meetings of creditors, and any in-person hearings within walking distance.

Conrad Legal accepts cases from anywhere in the Southern District of Indiana. Most clients come from Marion County and the eight surrounding counties:

Chapter 7 and Chapter 13 Bankruptcy

If you’re searching for a bankruptcy lawyer in Indianapolis, you’re probably weighing two questions: will I lose what I own, and which chapter actually fits my situation? Conrad Legal LLC files Chapter 7 and Chapter 13 cases in the U.S. Bankruptcy Court for the Southern District of Indiana. The right chapter depends on your income relative to Indiana’s median, the equity protected by Indiana’s exemptions, and whether you need to discharge unsecured debt or catch up on a mortgage arrearage. 

Chapter 7 

Chapter 7 discharges most unsecured debt, including credit cards, medical bills, personal loans, deficiency balances on repossessed vehicles, and most civil judgments. The typical case runs about four months from filing to discharge. To qualify, your household income must fall below Indiana’s median or pass the means test. Most filers keep their home, vehicle, retirement accounts, and household goods using Indiana’s bankruptcy exemptions. Indiana opted out of the federal exemption scheme, so the analysis is state-specific and worth doing with a lawyer before you file. 

Chapter 13 

Chapter 13 restructures debt into a three- or five-year repayment plan supervised by the Chapter 13 Trustee for the Southern District of Indiana. It’s the right tool in four common situations: when you’re behind on a mortgage and want to stop foreclosure, when you’re upside-down on a vehicle loan and need to cram down the balance, when your income disqualifies you from Chapter 7, or when you have non-dischargeable priority debt, such as recent income tax debt or domestic support arrears that has to be paid through the plan. Many clients repay only a fraction of their unsecured debt and discharge the balance when the plan completes.
